After Some advice on cross petitioning

Hi,

My Stbx wife Started divorce proceedings last year in may. It took her until Febuary this year to swear her affidavit,However this has now been rejected by the judge due to a clerical error by her solicitor she has now put in a new Petition on the 12th of April but is generally dragging her heels etc.Does anyone have any advice as she will not talk to me or have any contact with me what so ever so I wondered if it was worth me petitioning to get things moving.

In a word? Dont. If you do you will delay things a lot more. Believe me, its a lot easier being on the recieving end as all you have to do its return the service when you get it. If you X pettition, she will have to be served and that could take ages. A small error is usualy turned round quickly. So you shouldnt have to wait that long. Also, there is the cost of a pettition. Its about 380 quid now. And she could press for a costs order for her pettiton against you. So wait it out. U have waited this long. Its only a little while longer then you will be free of her. C.

It seems that although she is being very slow, she is progressing the divorce.Therefore you should not cross Petition or anything like that.Just return your paperwork as and when you need to.

If she does not progress the divorce for say 6 months, then you can take action. But while she is (ineptly) trying, I''m afraid there''s not much you can do.
