Hi all, asking for a friend of mine, their name only on deeds of house and they pay mort, will need to up mortgage to help pay bills for solicitor, can they use the £20 grand they can get to pay for this ? will this go against them in when it comes to financial settlement ? if money left from this amount will they have to give stbx and of it? thankyou if you need more info just ask, they in desperate need .

If your friend is married they need to speak to their solicitor first for advice, again if married their spouse may have registered a restriction to prevent them raising a charge against the property.

If married and their spouse agrees then its not a problem, but do bear in mind if this ends in court the judge will be aware of costs spent on lawyers by each side.

thankyou, she is aware of him raising funds this way and all is ok, He is paying legal costs and she is claiming legal aid.
