Hi there, sorry if this is in the wrong place, but I couldn't find a relevant section in the Finance area.

May be a naive question, but if you were getting separated or divorced, how would a spouse know if the other was hiding details of a bank account or savings that they didn't know about? In other words, if you didn't disclose info about all your accounts.

Not that I have any hidden fortune, but I guess it must happen quite often, partners stashing money away in secret accounts, or cash hidden away, so they wouldn't have to give away half? Just generally wondering.

The short answer is that you don't :(. However, you and the stbx have to produce 12 months bank statements with form E - and careful examination of those can show if unexplained amounts are being hived off ... questions can be asked about these when Form E's are exchanged. Or you may know about accounts that have not been declared on Form E and can ask for an explanation of what has happened to them...

It is not a good idea to hide assets pending divorce - if it is later discovered that there has not been full financial disclosure, any order can be set aside.

Form E is the form you both fill in that sets out your financial position when the ancillary relief (sorting out the finnaces) process begins.

HAve a look at the Wiki step by step guide and find the form and a guide to filling it in in Wiki resources. YOu can also search for the numerous posts about dratted Form E :laugh:.
