I have signed the very first court papers, the one where they set our the particulars for the divorce etc.

Does anybody know if it is too late for me to divorce him instead??

HF,

If the papers have been issued by the court, then yes it is too late.

You can 'cross-petition', but this is hugely expensive and not worth the additional personal angst that it would cause.

I am assuming that you want the divorce to happen?

In the grand scheme of things, divorec in the UK is no blame. It makes no difference to the outcome or to the financial settlement as to who issued proceedings. The content of the petition is between yourselves, your legal representatives, the judge and the court staff. Nobody else gets to see it, it is not published or in the public domain.

If you have reached the decision to divorce, then how it happens, or who drives it is really not very important at all.

What is more important is to concentrate on getting yourself in a better frame of mind, and recovering from the emotional trauma.

I know myself that I desperately wanted to get back at my stbx by cross-petitioning, but when the anger subsided, it was obvious to me that it was a pointless and expensive exercise in revenge.

Hope it helps, and take care of yourself first

Mike
