finance hearing(ancillary)

omg friend of mine has hearing next month, has been told that his ex wife is going for everything, state pension, half of business, house, spousal maintenance, lump sum and half of value of car !!!!
he has full custody of children aged 10 and 13, they live in family home which is soley in his name, he has small business which is owned equally with his father, along with works van. he earned £22,000 last year and pays all bills along with childcare, she lives in one bedroom flat and is on benefits, her outgoings are less than 500.00 per month. he has been told he could lose eevrything, he is in such a mess dont know what to do !! so the question i suppose i am asking is..... will the courts make him sell the house, and give her half of business and value of van,, please am at wits end if you need any other info to help please ask ...

How is he already in final hearing?- From what you say, she would have no shot of getting anywhere near that especailly as if the kids live with him. Kids= bulk of assets.

Also what he earns does not warrent SM

he had made an offer to her of £20,000 lump sum as long has he could keep the house, this offer would not affect her benefits, this has always been refused and she has been dragging out for 2 years now, they have Decree Nisi but no Absolute, it was her and her solicitor who decided to take this to court, mediation was set up, they went on seperate times, a letter was received by my friend stating that, **** was not suitable for mediation at this time, he dont know why, no explanation given.numerous friends and i have told him that ..no court would make him sell the house because of the children, he just now panicking because he thinks he will lose everything, have told him that they will not leave him and the children homeless and the business cant be devided because his father owns half . is this correct.. thankyou for your reply x

Tell him not to worry.
Look at any post on here and you will see that whoever has the kids, usually gets the bulk. She may have a stake in the house in the future (mesher) and she may get 50% of his pension- but as she has not got the responsibility of the kids, she will be expected to work.
