Hi. Wanting to proceed with putting the application in for Financial proceedings...there is a tick box for attaching the mediation form. I have contacted the mediator who said she would send the FM1 form but a week later still haven''t received it. (have left another message today!) Can I send in application and then send in form when I receive it or is it essential this gets submitted with application. Cant really delay much longer.

You can add its to follow but realistically they won''t process it without it, catch 22, can the mediator not email it so it can be printed with hard copy later?.

I dont have the FM1 either and want to file form A for MPS.

Stbx has Solicitor, he attended Mediation 1st app. only. When I received my Mediation letter. I informed them that he wont pay for this and wont attend further app either.

Asked her to contact me again in 2 weeks time to see if he changes his mind. He did''nt. I informed her with her call.

A letter did arrive that she will be sending the FM1 to his Solicitor. I made a copy of letter.

I have emailed his Sols to forward me a copy of this FM1. Never replied back.

Dont know what reasons are on this form why cancelled. Do I call the Mediation and ask for copy or am I not allowed to know what she stated.

How do I proceed if I want to File Form A and the FM1 then.

amefbi, your need sounds similar to mine...

My STBX attended mediation first and I got a letter inviting me. I declined as we''d already been negotiating for three years and he then refused to sign any agreements. Mediator write back saying fine, he''d issue FM1 to my Ex.

When STBX did nothing, I filed Form A myself. I attached an FM1, completing the section at the end to say I hadn''t attended MIAM and my reasons why. I also attached all correspondence with the Mediator.

My reasons would appear to have been accepted, I have a First Appointment date :)

How did you get the FM1 then? I dont have the FM1 his Sols has this.

Would like to know what boxes she ticked on the form and reasons for us not attending.
I was wondering is she will say I declined or what?..thats not true anyway.

Dont know what I should write on the form.
Or if he Sols has to give me a copy of FM1 if I need one.

Or what do I write down on Form A. I have 2 letters from them and my notes written on bottom in pen who I spoke to,dates and what I told her,etc..copies of these then?

I googled and downloaded a blank FM1. If you do the same, you''ll see the section I mean ... sorry to sound vague but I''m not at home just now so don''t have a copy to hand. Can check on Saturday if you want.
