I am faced with court a week Monday for a secured joint loan on the FMH which my stbx refuses to take any responsibility for.

I am scared stiff as I cannot seem to get legal aid and therefore will be unrepresented in court. I have written to the judge to tell him that I am willing to pay my half of the loan (I pay the whole mortgage at the minute) I only work part time and am barely surviving as it is.

My question is: when I go to court what are the chances of the house being taken if I am willing to pay but stbx isnt? There is no equity in the home at all and there will be monies owing if we have to sell at current market rate.

We have two young ish children and this is their home, I have no money for a deposit for a rental and I want and need to stay in the area. What are my chances of staying in the home do you think?
