Apply for Decree absolute but out of time

Hi,

I am the petitioner and applied for the Nisi which was granted.

Now want to file for the Absolute but am over the 12 month limit.

In addition to returning the D36 form for the Absolute my understanding is that I now need to apply for leave out of time and provide an explanation of why I didn't apply within 12 months (sorting finances out) and that we have not had another child together in that time or co-habited again.

My questions

1) Is there a form to complete to cover the after 12 month period and if so, where do I download this - or do I simply write a letter to the court and return with the D36

2) Is there an extra cost as after 12 months and if so, how do I pay this to the court?

Doing this myself so don't want to go to the solicitor at this stage

I would just write a letter to go with the d36 stating the delay is due to finances.

You also need to say you have not lived together as man and wife and no further children have been born of the marriage.

There is no extra cost.
