I went to the second hearing and we signed a Head of Agreement hand written by the judge.My ex asked if he could ask a former colleague of his, a solicitor to draw up the consent order and a I agreed. I was the petitioner for the divorce so I filed for the decree [url=Glossary/General/Absolute.html ]absolute[/url]. He was the applicant for the financial hearing. I received the decree [url=Glossary/General/Absolute.html ]absolute[/url] in June and two weeks ago I asked him for a draft of the consent order. He arranged for me to be given three copies of the order on the 3rd of July and asked that I sign them straight away and return them to him on the 4th so that he could send them to court for the hearing on the 12th of July.
I am reluctant to sign them because it says that he will transfer the home to me subject to me securing a mortgage within 56 days of the order.The head of agreement says I should endeavour to get a mortgage and if I fail to do so by the time our child leaves full time education the house will be sold. Am I right to seek legal advice? I can get the mortgage but now feel pressurised by the time frame and I work full time so I cant arrange to get a solicitor to read this order. Its all very last minute and I'm now worried about the hearing on Friday. The agreement I made at the last hearing was because I'd had enough.can anyone help me please?
