Divorce draft sent to me. What do I do? was created by musicteacher
I have been sent a copy of the divorce papers by my ex through his Co-op solicitor. In it was a concilliatory letter explaining that my ex is filing for divorce and a draft copy of the divorce application. The email says they await to hear from me within 21 days. I am not exactly sure what I do next. Do they want me to check it over and send it back? It feels like they are being deliberately vague. There is an error of spelling for one of my middle names.

This is your opportunity to advise the other side of any corrections that are required, such as the misspelling of a name, to review the statement of case before it is sent to court, and to negotiate around costs.

If you strongly disagree with one or more of the examples of behaviour, you can reply and request they are amended, or replaced with something else. I'd only be concerned if there were examples that included violent or abusive conduct, financial impropriety, unlawful or criminal behaviour, poor parenting skills, or examples that include the children. The other side don't have to comply with your request, but you can still ask.

If they have ticked the costs box, this means they will be seeking the costs of the application from you - do £500 for the court fee, and whatever the provider is charging for the divorce application. You could reply saying that you will fully engage with the process, won't delay returning your acknowledgement of service, but on the understanding that each party pays half the costs each (or you will pay up £X amount).

If you need any help, its worthwhile giving our helpline a call.

Thank you for your reply. I emailed back and mentioned the misspelling. Costs were not passed to me, we still have some joint money.
