Hi everyone, I haven’t been on here for a while! I obtained the Decree Nisi last year in June.

My husband has been persuing wrapping things up and taking it to court via his solicitor. We had a court hearing date in December which I managed to postpone.

The problem is I have been extremely ill with a virus for over 3 months, (suspected COVID by my doctor and he has referred me to the ‘Long COVID Clinic’ starting in January.)

We have a new Court Hearing due mid January. However, I still have to complete the E Form but I’m really not up to it as I still feel so ill!

My husband says it still has to go ahead because once you have filed a Decree Nisi you have to complete certain criteria and follow it through with the court?

I don’t believe this to be true as my friend did this with her husband and then they never pursued it any further!

We have agreed to go through a mediator regarding finances, yet my husband is still going down the court route?

Surely this is down to his solicitor pushing it forward for her own gains?

Sorry to hear you are unwell. If you are in the court process it is important to comply with court deadlines. You could ask the other side to agree an adjournment. One of the reasons to adjourn may be that you are going to mediation.

An application to court can usually only be made after mediation has been offered and rejected or tried and failed. It is often used as a means to obtain full financial disclosure if it is not forthcoming on a voluntary basis.
