Hi
I'm looking for info re a 2nd marriage ending. Both of us divorced previously - owned own homes - grown up children - in our early 60's.
He has lived in my house for 6 years, married for 5 years. Sold his property, bought a smaller property, mortgage free and rents it out - banked the remaining proceeds.
He pays (fairly) towards bills and food etc and general upkeep. He keeps all rent proceeds from his.
He wants to claim a share in my property if we divorce. Can he do that?
I think we should just part and be happy with keeping what is owned by us each and not claim against the other one.
Not sure where to find resources for this sort of situation. Any guidance on my situation appreciated.

He can make a claim but whether or not he gets anywhere is another matter. Far more usual in the circumstances to leave with what you each came into the marriage with.

Have there been any major investments made in your property during the marriage?

Post more details of incomes and assets.

we both work part time - his income which includes rental profit is about 3k£ more than mine - recent new bathroom paid for by by me - smaller improvements done by him recently and several years ago, no major home improvements - I have always helped him re his rental of previous home and current rental i.e tax returns/admin/tenant contact etc- we both have private pension funds set up decades ago before we met so have our own independent means for retirement in the future.
If I ask him to move into his flat which is currently rented out, he will lose that as part of his income so says I should support him financially - even though he has nearly 180k£ cash left from sale of his home -
It's very sad that things have gone wrong between us.

Would his income, without the rental, be enough to support himself?

How much is a one bed place where you live? If he could buy somewhere with the £180k then he could still have the rental income. More detail is needed.
