If you are living in the house with a minor child or children and a home rights notice I cannot imagine a court won't approve a delay in final order.
If you make the application and he takes legal advice this is what he will be told.
It may be the matter is determined in writing but even if you do have to attend court this appears to be so cut and dried that you will be fine. You can take someone with you as a supporter.
