Hi my husband has asked for a stay on the divorce , we are in court next month .
He says he wants spousal maintenance from me , he earns more ! And that I have a big pension , which I don't . I have all my form E pack ready and he is the one delaying it , yet asking to put a stay , this is all part of his controlling behaviour . Does anyone have any advice of how to represent myself in court and what the likely hood a stay is granted . Thank you in advance

Is the hearing for finances or about the stay?
Clearly if you are in the court process and have exchanged Form E you may have evidence to support your objection to the stay. NB If he has a substantial pension and you do not, this could be a reason not to finalise the divorce until finances are settled. Other reasons would be if there's a home rights notice in place - this ceases on final order - or if there's a prospect of maintenance pending suit. I would suggest you submit a position statement setting out your objections to the stay.

If you are in the financial remedy process, file your Form E with the court. Then let him know you have filed and are ready to exchange. If he does not, it is the court he's answerable to. A short adjournment may be ordered - say 4 weeks - to give him chance to comply.
