Hi, looking to apply for financial order, we were married 14 years he has kids two nights a month, I have them the rest. Approx 140 k equity in house but I pay all the mortgage and bills, have never recvd spousal maintenance but just get maintenance for the 3 children. I also paid 17 k off the mortgage with money I had before we met or married. He is a partner in a business and has a pension etc,..
I estimate a 70/30 split is this normal .? Plus we signed a Separation Agreement which he isn''t wanting to adhere to now

Who contributed what is less important with the passing of time and when there are children. Divorce settlements depend on the particular detail a nd there isn''t enough information for anyone to give an educated opinion as to whether a 70:30 split is likely. IT depends on the value of any assets (including pensions) held in joint or sole names, respective incomes, duration of the relationship (marriage + cohabitation before), ages, number of children, their ages and any particular fact such as disability that could be relevant.

The aim is to achieve a settlement that leaves both parties on a similar financial footing rather than a mathematical percentage split.

Having said that if there was full disclosure, both parties had independent legal advice and an agreement is fair (complies with the law) a separation agreement will carry considerable weight and a court can make an order in the same terms as the agreement.

Thanks, were together 17 years,snd I currently work lunchtimes after a 7 year job break to raise the children while he earns over 30k a year. I estimate his partnership in a business to be worth around 100k, there is approx 140k equity in the house and pensions are about 50 k each . My eldest son is also classed as disabled for his needs
