Hello everyone,I'm new to the forum and wanted to introduce myself and share my situation. I'm seeking advice on obtaining a financial Clean Break following a short marriage. My circumstances:
  • Married in August 2022, separated in April 2023 (8 months)
  • Total relationship duration: ~30 months
  • No shared assets or financial ties
  • One child (4 years old), maintenance arranged through CMS
  • divorce application submitted and accepted recently
I'm aiming for a Financial Consent Order with a Clean Break. However, my ex-wife is not agreeing to this arrangement. She's demanding details of my pension and a settlement I received from a former employer in January 2023. She's also claiming I lived in her house (owned by her mother) rent-free.I've proposed a clean break with no financial claims from either party, continuing child maintenance as currently arranged. However, she has rejected this offer. Background:
  • Experienced domestic abuse during the relationship - evidence obtained which makes us exempt from mediation when we've had child proceedings in court.
  • Ex-partner has a history of manipulating children in previous relationships. And know she will eventually turn my girl against me as she did with her other children and their dad. One of her children has no knowledge of who her dad is.
  • Currently have a Child Arrangement Order, but ex frequently breaches it
  • Financial abuse during the relationship led to work performance issues, oversending, wedding and general relationship expenses I couldnt afford but pressured into spending.
I've completed a D81 Statement of Information form and am preparing for the Conditional Order application in July 2025. I'm unsure how to proceed to achieve a clean break, especially if my ex won't engage in a consent order.Given the short duration of the marriage and our financial situations, I believe a clean break is fair. However, I'm concerned about potential court costs if this becomes contentious. I'm also concerned that she manipulates the system so she works minimum hours to cry poverty while earning far more than me in benefit money (I believe fraudulently claimed) so her lifestyle is extremely expensive. But as a full time worker I may look like I earn more than her which I'm concerned might work in her favour in a financial order situation.

I was hoping to avoid solicitor fees and complete the divorce/financial order myself but concerned I won't complete it correctly not to mention the ex-wife being savvy enough to be as problematic/contentious as possible.Any advice on how to proceed or experiences with similar situations would be greatly appreciated.
