Will I be forced to sell

I wonder if anyone out there can give me some advive.

Situation is: House purchased approx 5 years ago for £144k. We got the house cheap as we purchased it from my ex''s former partner. House was probably worth about £180K

Nearly 2 years ago he left (with my so called best friend!!) and has been living in rented property ever since.

For the first few month he gave £200 towards mortgage, but from 18mths ago I have been paying the mortgage solely with no help towards mainenance costs etc.

He is now trying to force me to sell. He has stated privately to me that he wants the £40k that he perceives that he put into the property as well as half the equity - leaving me with virtually nothing.

There are no children from this relationship, although I do have my son living with me who is 19 years old and in further education.

I have today received a solicitors letter telling me that he is taking me to court to force me to sell.

Question is:
1. is he entitled to what he believes or just half of the equity.

2. How long does this process take

3. Would the judge take into account the fact that I have a serious medical condition?

I would be really grateful for some advice as I am at a loss to know what to do next.

If you weren''t married, our advice will be very different.

We were never married.

If you were not married, then the property will be divided according to what the deeds say. If it is joint names with no indication re shares it will be 50:50.
If it is in his sole name, you would have to claim beneficial interest. You can find out more by using the site search bar at the top of the page.

I did have a feeling that it would be 50/50 which I am fine about. Do you know how long this process takes. I really do not want to move but am aware that this will probably be inevitable.

Does my illness make any difference to the outcome.
