I will be staying in the matrimonial home(owned outright) with my 11yr old.
What sort of support might i be entitled to when it comes to the upkeep of the property untill my child reaches 18/19.
Will my STBX have to pay maintenance to me, help with the cost of house repairs/upkeep,after all he will be getting his share in due course.
What sort of things might he be expected to help with.

Not a question that can be answered without more information I''m afraid. Comparative incomes, health, age and all that. At the end of the day it all comes down to ''need and ability to pay''.

Assuming your ex is the father of your child then you will be entitled to CM.

You may possibly be entitled to SM, it depends on your incomes and how you are splitting the assets now.

You mention that your ex will be getting his share of the equity in the FMH "in due course" so presumably you have a Mesher order in mind where you get to stay in the FMH and your ex gets a % in the future?

If this is the case you would usually be expected to pay the mortgage and upkeep of the house yourself but that would be balanced out as you wouldn''t be expected to pay your ex rent for their share while you lived in it.

We have no orders in place,i am just wondering what would be acceptable for me to ask for financial help with. ie:upkeep/repairs to the house (which is owned outright)myself and 11yr old child live in it and will continue to do so.
We are in the process of attending 1st mediation.
CM and SM will be discussed but i was wondering who is responsible for the property upkeep. Is it solely my resposibility even though my STBX will receive a % in the future.

Yes upkeep and repairs would solely be the responsibility of the person living there.

This seems unreasonable. Surely if you are joint owners it is a shared responsibility. I am in the same position except my youngest child is at university and we still have a small mortgage. My ex pays the mortgage still, I don''t.
