Hi folks, like many others here, im going through the same crap divorce where I seem to hold no cards. Im earning £2000 pcm and currently pay the mortgage, all the bills and child maintenance which leaves me with £700.Ive moved out of the house, now living with my mum and looking for a place. Im not holding much hope due to the fact that I pay £300 in fuel costs to work so Im left with hardly any money after forcing £300pcm onto my mum for my keep. The question i have is do i have to pay the bills and all mortgage and if i dont, will the courts take a dim view of this?
She has never worked,I have 2 Kids, 17yrs and 14yrs and were both on the mortgage.
She is going for spousal maintenance and my pension but has recently inherited approx £180k in assets and cash.

Why have you moved out if you are paying the mortgage?

I''m not an expert and I''m sure you''ll get more advice but why are you paying the mortgage when you''re not living there? I understand your ex doesn''t have an income - presumably you''re paying CM aswell?
You are setting a president by paying for everything - are there any other assets ?
Usually all the assets go into the pot so if she has inherited money I''m presuming that too will go into the pot - is this money she can access - because if so she should be paying the mortgage and gills if she''s living there.
If you want advice regarding a fair split you''ll need to give a little more info regarding your ages, assets, debts, income, pensions etc..
Is there any reason why your stbx cannot work due to illness or anything if not she will be expected to get some sort of employment to be able to support herself - SM is only usually payable if there is a need and if you can afford it. Will the house be sold? You''ll both need somewhere to live - have you taken legal advice from a family law specialist?
