New baby with new partner - child maintenance

Hi all, I will become a dad again later on in the year and have a court order to pay child maintenance to the ex. Can I reduce that amount once the new child is born or will it have to stay the same? Will it need to go to court again?

Unless I am much mistaken, child support is paid to the CMS and your liability to pay child support t is determined by reference to the statutory formula.

It is not usual for child maintenance to be included in a Court order.

It is always open to apply for a variation on the grounds of changed circumstances.

Do you by chance have an order for combined spousal maintenance and child support with a provision that any child maintenance you pay is t hen deducted from the global figure ?

My partners child maintenance is reduced because my daughter lives with us and is classed as his dependent even though she's not 'his'. So I would presume that it will be reduced through the CMS just call them when baby is born and tell them your circumstances have changed.

If you have a Consent Order for CM that is more than a year old it will end if you make an application to CMS.

Check to see how much you would pay via CMS and then make your mind up. Probably cheaper at £20 for the assessment than applying to Court for a variation.
