hi iv been divorced for 8 years and until the last 3 years have been paying my ex wife child maintance threw the bank, a couple of years ago she asked me if I could pay her cash as she is on dla and didn't want it to affect her benefits , so iv been doing that , looking at financial side of divorce agreement it states she will not contact csa, but as long as I pay she will release the 20%of house sale to me when my youngest is 18, does she have a case against me , as there is no stipulation in financial agreement how she is paid the maintinance

Receiving CM won't affect benefits.

Is she now claiming that you haven't paid? The problem with paying in cash is that it is difficult to prove.

You can't write into a Court Order that someone won't claim via CSA (now CMS). The legal right to claim cannot be removed.

On what basis do you currently pay?

solicitors papers say Mrs jm has also agreed not to seek any additional monies by the csa whilst the provision of for your payment of of maintenance to the children continues, we have a letter from csa saying she hasn't contacted them in the last month. so who will they believe her or me, as she's being paid and hasn't gone to csa
