No, it has to have an element of spousal maintenance to be legal so it absolutely can be returned to court to be varied. If CMS child maintenance exceeds global maintenance it can often be terminated (although the risk in taking it to court is that it gets increased). In my experience people don't tend to agree to global maintenance these days, they have it forced on them.

I think the OP has made the right decision to get strict with her partner about the sharing of the bills.
