Validity Period of FM1?

Looks like I''m going to have to play any divorce & financial orders absolutely by the book, as I''m being thwarted by any attempts to move things along

I understand that I have to attend a MIAM prior to submitting Form A to start financial proceedings, and that I need to obtain a completed FM1.

Does anybody know how long that FM1 is valid for?

I don''t know whether I''ll be a position to submit Form A later this year (if STBX petitions me for divorce) or in March 2014 (if I have to wait for 5 years separation). I''d like to get ahead of the game in case he petitions me this year, so ideally would like to arrange a MIAM as soon as; but don''t want to find I have to repeat the experience in 2014 due to any expiry of the FM1.

I''ve just looked at my BF''s FM1 and it doesn''t state a time period of validity.

I don''t know if there is one, but from a Court point of view someone could have changed their mind about mediation within days/weeks or years.

My BF tried to arrange mediation and his Ex refused, the Form FM1 cost him a phone call & £50.

Probably best to wait until you''re in the Nisi stage before applying - then you''re sure the Divorce part is underway.

Rather than wait for him to Petition you, can you petition him?

There''s a long story behind why my only two options are either for him to petition; or for me to wait until the 5 years (2014)

My only worry is that if I wait for the Nisi Petition, what will the waiting list be like for mediation? I''d like to be ready to submit Form A immediately after Nisi is pronounced, and I don''t want a three-month waiting list for a mediation appointment.

Love to know where you can get telephone mediation & FM1 for £50, everywhere I''ve looked locally says I have to attend in person and pay around £100.

He called up (the mediation service) and they said he would have to attend and it would cost £95 (per person), they took £50 deposit over the phone and wanted the other £45 at the appointment. They then phoned his ex to arrange her appointment and she refused, so they phoned him back and said she wouldn''t go, so they would be keeping the £50 deposit and sending him the FM1, no appointment necessary if she wasn''t going to play ball.

All in all around 15 mins for them to explain the procedures and costs and called back 10 mins later to say it was a no go.

At least she did this before the meeting otherwise he would have wasted the full £95.

The way STBX is mucking mey around, he''d probably say he is coming to the mediation and then not turn up. But if I need to pay the £100 to get that FM1, then I will.

My stbx was advice by his sols Mediation. He attended his 1st appointment.He informed me he is not going back, she asked to many questions, and she will inform me to attend. He wont pay £1000plus they are crazy.
(I am informed on Mediation process, he has no clue)

I did receive letter to attend and called them. That he wont go back and wont pay and I dont have the funds for 1st appointment.
She called back 2 weeks later to confirm this is still the situation.

Todays letter from Mediation to him, States they have been in contact with me to see if Im willing to attend. I advised them Im unable to use the process at this time. She has sent a completed FM1 to his sols.

Ive just read this FM1 and only ''tick'' on form is that he attended the initial 1st app.

Do they send their findings on seperate document to sols? Im worried now that she might just mention that Im not willing to attend.

If I file Form A I have to state No I did not attend...No explaining as to why and I suspect his sols will also have same info..I did not attend.

I dont have solicitor yet and Im Respondant before Nisi.

I don''t think there is a waiting list - I applied for divorce, then stbx applied for mediation and we had phone call etc all sorted, before the Nisi even came through. Our nisi has been a bit delayed due to post going missing, but even so there was no waiting for the mediation.
Plus, there are several companies offering mediation, so if one does have a waiting lists then look around for a different one.
