Hello,

I am asking this question on behalf of my sister-in-law, she was married to a soldier warrant officer class 2 for 16 years, on the divorce she was awarded £25,000 however this was to be awarded on her or 3 months prior to her 60th birthday!! she was not advised about the Lump sum he was given after commutation, this was not even discussed by her legal team! she has not been awarded any monthly income from his pension which he gets around £800 pcm. The award at 60 years old doesnt seem right as his next payout or pension rise will take place on his 55th birthday. After having a long discussion with her i found all the information she received a little frustrating as i served for 22years also and i have first hand knowledge of the pension scheme AFPS 75. What if anything can she now do about the advice she was given.

It seems full financial disclosure was not made, was the agreement made written as a Consent Order and then approved by court?,

Does he in fact draw his pension?

Had he commenced doing so when they were still together?

I have a forces pension and my ex conveniently forgets that the lump sum that was obtained was in fact spent on the family in holidays, credit card debts, premium bonds and her car. Most of which was hers.

The £1500 I spent on a bike though was mentioned a lot.
