i have been married 25 years, but we were only together 9 years, does anyone know what percentage of pension i would be entitled to, the pension is 22 years old

This is a tricky one. Are you still legally married? Is there a divorce going through at the moment? Are there any other assets owned jointly or in sole names? Do you have a pension? Do you know the CETV of the pension concerned, is it in payment?

The thing is that as long as you are married, all assets - that includes houses, savings etc etc and pensions - all go into the marital pot for division. They can then be taken out either by agreement ... if you can negotiate with each other OR if you cannot agree, a court will ultimately order division. Where there is a long gap between separation and divorce it is still entirely possible that a court would still order a division based on assets on divorce ... this has certainly happened in the case of property equity to people here on wikivorce although I am not 100% certain how it would work with pensions.

Remember where a pension is concerned that as long as you are married, you would be eligible for any widow's benefits.

Do you have anything in mind that you feel would be fair?

yes still married currently going threw the divorce, still awaiting to hear value of pension, no other assetts to share,just his pension, will the pension be spilt on the amount of years we are married or amount of time we were actually together

There is no simple answer ... A lot will depend on how much the pension is actually worth and how it may be shared. It would be useful if you also knew what the pension benefits are - ie lump sum and annual pension to be paid from the existing pot.
