Hi

Can anyone help me? My other half has an army pension which is in payment. In addition to this he has an NHS pension, which is not in payment yet. I have a much smaller pension (only contributed for 4 years and left the job). We are instructing an actuary to work out the pension share in my favour, but he is insisting that the share comes out of his army pension so that the NHS stays intact. Problem is I want a pension sharing Order (Clean Break), to collect the pension when I am 55 as opposed to an attachment order now (where it can be altered at his whim if my circumstances change). He cant force the issue and say I have to have an attachment order when I dont want one can he?

To cut a long story short if you both can`t agree how to share the pensions ultimately a judge will decide regardless of your respective preferences, all pensions will be considered with the help of the actuarial report including pension in payment and the other yet to mature.

Just a thought, is it right then that a judge could insists I had an attachment order, even thought there are loads of implications with that due to my future? Also does future income bear an relevance, as he has a greater earning capacity than me as a result of my break to look after children?
