HI JUST SEPERATED I AM LIVING IN HOUSE IN MY NAME I BOUGHT STBX LIVING IN HIS HOUSE HE BOUGHT IN HIS NAME WE ARE SELLING JOINT PROPERTY WE BOTH BOUGHT IN BOTH NAMES AND GOING 50/50 ON ANY PROFIT WE MAKE. BOTH PROPERTYS WE ARE LIVING IN ARE WORTH THE SAME I WOULD LIKE TO USE PROFIT I MAKE TO BUY NEW HOUSE TO LIVE IN AND RENT OUT MY OWN HOUSE to our two grown up sons with this property going to them in the future, STBX AND I HAVE NOT MADE A Consent Order YET IF I BUY A NEW PROPERTY CAN STBX MAKE A CLAIM ON NEW PROPERTY? HE IS GOING TO SPEND HIS PROFIT ON HOLIDAYS. help confused

Hello i dont know all your details (length of marrige ect)but im in the same position so this is what i know.
Property purchased after seperation is not included in the marrital pot but the deposit you used is and same for him if both propertys yours and his have similar equity why not aviod form E and disclosure agrea terms with him and used form d81 (simpler version of e) and draw up a consent order (use a sol for this) it will save a few quid

Hi, If you are separated but not yet divorced I would suggest you get a deed of separation drawn up with a solicitor setting out what will happen to your assets and debts on divorce. Providing you both seek legal advice and there is a full disclosure then this deed can be turned into a consent order when you get your divorce absolute. It saves an awful lot of hassle at some future date and a cost effective way of securing your assets so that ex cannot make a future claim on them.

when you say properties purchased after separation do not count in finacial settlement can you be more precise.

I'm buying my s2bx a house on friday for her to live in so she'll be moving out on the weekend so i guess thats when we separate, although we've been based in the same house for the last 4/5 months living as if separated (although she still does housework and I still bring in the money).

I'm concerned by your comment that this house I buy her will not be included in the financial settlement.:(
