Can he register matrimonial rights?

There is no equity in the house and I also have around £40k worth of debt that has all incurred during the relationship.

Is there anything I can do before dropping the divorce line to get things in order and make things easier for myself?

No nothing you need to do really. It''s best ot agree a financial split with your STBX if you can. If you can do it yourselves then you''ll both save a bundle in sol''s fees.

Will his child be considered in the divorce? I just know he''s going to try every trick in the book and apply for me to pay him support. Would it be more benificial for me to move in with my parents as i would struggle to live when he moves out (but would just manage) or should i stay put? There is no way that the landlord would let him take to tenancy on his own so the options are he moves out or we both move out.

It would be a consideration, yes. He could claim he needs a 2-bed accommodation for overnight access. But it probably won''t change things much. If he thinks he''s getting SM out of you he will get a shock when he rre-joins the real world.
