After self repping and finally having an agreement the judge has ordered that we take a) a draft order; and (is this a Consent Order?)
b) confirmation that the mortgagees have been notified in accordance with the rules
We have agreed that i pay off the joint debt and houses are signed to me. The judge said this was fair at the last hearing.
Do I have to use a solicitor? I have someone to do the transfer of houses but the solicitor I''ve jsut rung for a price says they''d need to see all financial information. form Es have been submitted and I want the matter resolved asap now we are in agreement. Previously when using solicitors they have just prolonged things and made things more complicated.

Hi Mel

Yes when the judge says draft order he/she is talking about a draft consent order, only a solicitor can write this for you, don`t worry though wiki offer the service for £139 and no they wont encourage any argument, its simple you tell the solicitor what the agreement is, they write it, you both sign it send it back to the solicitor and they then send it to the a court you attended to be sealed by the same judge you spoke to.

The conformation is something in writing from the lender to say they know what the agreement is, that should be easy to get, a printed email is fine.

Thanks Dukey, I''ll get on that then. Unfortunately my lenders have not responded to the original letter I sent them. I''ll have to chase them too now!

If you can get the name of someone to correspond with or you''ll end up telling the whole story ever time you call, if they ask for a letter make sure you keep a copy and send it recorded so you can proof they have it.

The consent order is the easy bit and takes a couple of weeks to sort out from when you make the order.

Quick tip for anyone reading this thinking of using a interwb service for divorce, the first question to ask is if i pay you money does a solicitor do the work, if the answer is no or a solicitor only does bits, put the phone down.

That`s really the job of the solicitor Mel, but yes form A is sent and at the top its written "For dismissal purposes only" with the box`s ticked and signed by the applicant.

For D81 is also usually sent but in your case its probably not required, the judge knows the financial situation.
