My husband has been arrested and charged with domestic violence, I chose to leave marital home which we had owned together 18 months, although only married for 15 months. I put over £200k into the property from my house sale and he put in £15k .... I didn't take a pre nup out as he convinced me we wouldn't need it. Needless to say he's wanted 50/50. I have a full paper trail and bank statements .... what are my chances I get it all back?

How long did you live together in total?
Short marriage with no kids you usually each leave with what you came with and share any increase in marital assets.

You may need to give him more than £15k to reflect the increase in value of the FMH but nothing like 50/50.

If he is expecting 50/50 he is heading for a reality check.

Scots law is very different to the law in England and Wales. There are few people on this site with sufficient knowledge to comment. You would be well advised to seek a free half hour consultation with a Scottish divorce specialist.
