A single mother who lost an appeal against her ex-partner's settlement which included a £1.1m house has vowed to take her case to the European Court. The woman, who cannot be named, was awarded the London house plus an index-linked £75,000 a year in maintenance for herself and her daughter, aged 11.

The Court of Appeal refused her permission on Wednesday to appeal against the settlement figures. However, outside court, the mother said she would take the case further. "I shall be taking this case to the European Court," she said.

'Final round'

One of the main points which the mother, described as KSJ, wished to appeal was the periodical payment figure set by the High Court. The original award was reached after the case had been heard by 11 judges of the High Court Family Divisions in hearings which began in April 2000.

The appeal judge pointed out that Mr Justice Bennett had concluded in a ruling of August 2004: "I hope that this hearing really will represent the final round of hostilities. "The mother and father have a lovely daughter who brings them much happiness and to whom they are both devoted. "If I may put it colloquially and bluntly: for her sake, give her a break."
