Joint Debts

Whether you are married, in a civil partnership or living together, you and your spouse or partner are both legally responsible for the whole amount of any overdraft on joint bank accounts and other joint loans regardless of who borrowed or spent the money or kept the item that the loan bought.

You will be responsible for the entire sums due if the other person does not pay up. Try to agree how the repayments will be made until any final financial agreements are in place and also how the debt is going to be repaid in full in the longer term.

If you have a credit card and your spouse or partner are an additional cardholder, you are legally responsible for the whole debt on the card, the additional cardholder is not responsible.
