Today a sherriff ran rough shod over procedure and awarded orders amounting to over 50% of my disposable income - i live overseas so was not there but my sol just called me to give me the gory details. One piece of good news is that he also set a proof date.

The details are that the sherriff has implemented an order for an interim aliment, a child maintenanec order and payment of private school fee's by me. He refused to look at any productions or listen to my sol exoplain i simply cannot pay tjhis amount as it is over 50% of my take home pay. He did not even listenn to my sol when he asked the sherriff to at elast get the other side to produce eveidence of need. basiccally my sol was blown away.

Proof is set for Mid Novemeber - it will be a5 day proof (incidentally i was married for less than two years adn we split up in 2004 - i have spent almosy $60,000 on legal fees so far).

I have also commissioned counsel and my sol will meet with her tonight to take instruction but in the interim i just simply cannot pay.

I live in the USA - can anyone pass on any advice on wheter an appeal path is worthwhile, or if i simply refuse to pay any more than i can afford waht their options are?

I do nto have any reources in the UK.
