I have done upto the divorce decree by myself with support from wikivorce. now i need to apply for financial settlement.
I am too scared of writing to the respondent's solicitors. Simply because the finances have already been highly manipulated by my spouse. E.g. properties remortgaged, huge monies given away as gifts to family, his sister is an accountant - which means expert advice of hiding money.
I find myself in a very disputable situation. courage depletes as once marches in unknown fearful territories.
If you apply for a financial order, then as part of the process each side has to declare all their assets, and you'll have the chance to challenge/query anything you think is not correct.
The first step is you issue a "Form A", you'll get a notice of the first hearing where the Judge will set out the next steps that have to be completed before the second hearing.
I'm a bit ahead of you in that I'm just about to go through my second hearing. I've done all this so far as Litigant in Person using advice from here and also using a solicitor strictly as and when necessary. It is daunting but there is a huge amount of help here, and you can also access further help through Wikivorce's services.
My STBEX has repeatedly stalled the process (I gave up on mediation as he wouldn't comply with requirements there) and didn't want to reveal his pensions etc, but the legal process has meant that he has had to, and it's given me a means to get everything on the table, so to speak.
My costs have been really minimal. He's using a solicitor and his are quite frankly, a bit scary but that's his choice
My advice is take it one step at a time.
As an aside, a top tip I was given for the hearings (they're by video still in my area - I think they are still nationally) is to put a post it note over the STBEX's picture so you don't have to look at them. It definitely takes away some of the stress for me, as seeing him would be quite triggering.
Thank you indeed for your motivation. I am going out of the country for 2 months from november 21.
Given that form A is submitted, what if a date is set by the court and I am unable to provide all details on form E ? maybe lack of internet or wifi in the other country?
In that case, can i again request the court to give another date when I return to england?
This is a huge question in my mind since past 15 days, no courts are able to answer.
Will appreciate your knowledge and expertise on this issue please.
