what constitutes adultery? does it have to be penetrative sex? what about oral sex or manual sex?
or even hands inside underclothes? does orgasm have to happen.
can anyone advise?

Adultery is the full sex act. In practice though, this is a distinction that rarely matters. Behaviour which falls slightly short of "Adultery" readily constitutes "Unreasonable Behaviour" for the purposes of obtaining a divorce.

oral sex is now classified as sex, so if you can prove your partner had oral sex with someone of the opposite sex that was not you, he has committed adultery. orgasm does not have to take place.

sorry he or she. and yes any other forms of 'messing about' would be sufficient grounds for unreasonable behaviour.

Hi Joanna,

Where did you get your information from?

To the best of my knowledge the legal definition of 'adultery' is vaginal penetration between members of the opposite sex, consequently there can be no grounds for 'adultery' within a civil partnership; it's classed as unreasonable behaviour.

Orgasm, as you say, is legally irrelevant.

YA

I was thinking the same thing, I have just scoured the internet and it says nothing about oral sex being classed as adultery only what youngagain has just stated...
