What is included in this service?


Using this service you jointly appoint an arbitrator to review your case, consider the facts and legal arguments, and make a decision on a fair settlement.

The key deliverable of this service is a binding decision on your case.

The detail of what is included varies based on Option 1 and Option 2 of this service:

Option 1 : Arbitration based on written submissions.

Service includes:

  1. Both parties will provide written submissions based on a template/structure provided by the arbitrator.
  2. The arbitrator will consider the written submissions (seeking clarifications where necessary)
  3. The arbitrator will make a decision based on family law, particularly Section 25.
  4.  The arbitrator will communicate the decision in writing to the two parties


Option 2 : Arbitration based on a live hearing.

Service includes:

  1. A date for a hearing (at a convenient location) will be set
  2. Both parties will provide written submissions based on a template/structure provided by the arbitrator.
  3. Both parties may optionally choose to be represented at the hearing by legal counsel (solicitor or barrister).
  4. At the hearing the arbitrator will consider both the written submissions and the verbal legal arguments from both parties.
  5. The arbitrator will make a decision based on family law particularly Section 25.
  6.  The final order will be communicated at the end of the hearing (or in some circumstances at a later date if judgement is reserved).


For both options above the final decision will need to be written up as a Consent Order and submitted to court. This can be done through the Wikivorce Consent Order service at a cost of £259.
