What is mediation?

Mediation is an effective approach to resolving disagreements between a divorcing (or separating) couple. A family mediator can facilitate a series of discussions between the couple in order to arrive at a joint agreement over key issues such as finances (including property and pensions) and child arrangements.

Mediation is voluntary - neither party can be compelled to attend joint mediation sessions. However a recent government policy change means that you cannot apply to court for a contested financial/child hearing without first considering mediation, which means setting up a MIAM (Mediation Information and Assessment Meeting) with a mediator to discuss the benefits of mediation and assess whether mediation would be suitable in your circumstances.

What are the benefits of mediation, compared to going to court?

There are a range of options available to separating couples who are trying to reach an agreement on finances and children. The four main options are: informal discussions between the parties, formal negotiation via solicitors, using a mediation service or going to court. Informal discussions can work well for simple cases where the parties are on very good terms. However, where there are substantive disagreements couples often find themselves using expensive solicitors and going through a lengthy court process. For many of these couples, mediation is a much better solution for the following reasons:

Using mediation is generally much quicker than the court process

A contested court case may take 6 to 12 months verses 2 to 3 months for mediation.

Mediation is far less costly on average than contested court cases

Mediation costs a few hundred pounds verses several thousands of pounds for court

Mediation puts the couple in control of the shaping the agreement

A court can sometimes impose a decision which does not suit either party.

Avoids further damaging your relationship with your ex and your children.

Lengthy and acrimonious court battles can increase the resentment between couples

More flexible and personalised agreements can be reached

You can explore many different options in mediation, unlike inflexible court outcomes

Sessions of mediation can be arranged at a time and place to suit you

Unlike contested court hearing dates which may clash with work or holidays.

Couples have more 'Buy-in' to agreements reached through mediation

Some people continue to fight and challenge an 'unfair' agreement imposed by the court..

Mediated agreements can be made legally binding without attending court

Agreements reached in mediation can be made into a legally binding Consent Order.

1) Call our helpline to discuss your situation:

Although we have tried to provide comprehensive information about mediation on the website, we do suggest that you speak to one of our advisors on 01202 805020 before you order the mediation service. We would like to make sure that you have a good understanding of the service and how it fits in with the wider divorce and separation process before you proceed, and also to confirm that your case is suitable for mediation.

2) Place your Order:

You can order through our secure website by pressing the 'Order Now' button below, or you can call our free helpline on 01202 805020 and speak to an expert advisor who can answer your questions and take a telephone order.

3) Questionnaire:

We will email a link to a short online questionnaire for you to complete.

The questionnaire asks for the following information:
a) the name and address of both parties
b) the nature of the issues that you wish to discuss (typically finances and/or children)
c) the status of your case (what stage of the divorce/separation process you have reached).

4) First appointment scheduled:

Our local mediation service will contact you to arrange an appointment date and time.

5) Meet local mediation for MIAM (Mediation Information and Assessment Meeting):

You will meet up with a local mediator at their office. They will tell you how mediation works and describe what happens in a typical joint mediation session. The rules of mediation (such as their impartiality, confidentiality etc) will be covered. They will discuss some of the background to your case and will want to understand your objectives and expectations of the mediation process.

6) Invite your (ex) spouse or partner to mediation:

The mediator will try to contact the other party by phone/email/letter to inform them that you wish to use mediation and invite them to attend a similar introductory MIAM session.

7) If the other party agrees to attend mediation:

Your (ex) spouse or partner will meet with the same mediator for their own individual MIAM session. If after that they agree to proceed then a date will be set for a first joint session of mediation, and in the meantime you will both be given some forms to complete ahead of the joint session (in the case of a financial mediation this will entail both parties disclosing their financial situation to the other party, e.g. salary, savings, debts, pensions etc).

calendar.jpg

8) If mediation doesn't go ahead:

Mediation cannot proceed unless both parties agree to mediate. Also sometimes mediation may be deemed unsuitable (for example due to domestic violence issues). If mediation does not proceed then you can ask the mediator for an FM1 certificate which allows you to take the case to court
