What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I signed a Consent Order last week which we both agreed on, it was sent to court on Friday and they tried to get it in front of the judge, but due to time etc they didnt manage to vacate the hearing

I dont think my ex will even turn up either... I asked if I was required but the court said they couldnt advise me

Im now going to the hearing tomorrow, do you think it will just be a matter of rubber stamping the order or will it be a full review? and is this normal?

Hi Just Jack

I`m no expert, but I thought that if the consent order has been agreed and signed by both parties, then it is stamped at court regardless as whether you are there or not and then that is an end to the finances and usually a Clean Break.

Hi Saffy

I thought so too, but it has to be approved by a judge (apparently)

As I mentioned they havent seen it as yet so I suppose I have to turn up for the trial...

Just has a quick look at your profile and I see that you are already divorced. Finances are better to sort out before absolute so maybe this is why consent order is complicated. You could phone the number on here for some advice and book a free half hour consultation.

Wish you luck

All finaces are complete, everything has been agreed and now in place

The consent order is now more or less a clean break as it just says we will both pay our own fees and make no claim against each other

It been through solicitors etc so its solid

Just a bit weird that they didnt have the time to complete it, but hey courts are busy places

Courts are very busy....i`m a little embarrassed to say I have been naughty. My consent order has been agreed and I received it etc, sent it back to sol signed my me as well as s2bx. All at sols and waiting to go to court but I received a letter last week asking that I send a cheque for £40 to cover court fees as Im not covered this time for the fee remission. Have sat on it rather.....so pissed off as I paid to marry this silly man and now am paying to divorce him. I`m on legal aid but its only a loan and has to be paid back. Sorry for ranting on your post!!

Will send off my cheque tomorrow and get it stamped in court....AAaaahhhhhh.....hate all this.

Good new is, my absolute should be 24 Nov, so I will be having a divorce party at my house on 29 Nov...look at events.
