Once the Consent Order has been signed and agreed by the court, the pension sharing order is in effect implemented from the date of Absolute.

i know it looks like im going round and round with this and i guess i need to make a decision and then not think 'if only' his argument is ok his pension will be worth more in the future but if i off set the house,then so will that....fair point....also if i want some of his pension then i guess everything else gets divved up and i have to sell the house and get somewhere smaller.....so his offer is......i have the largest endowment...and the house....he pays off the loans with the other endowment...i keep my pension he keeps his....oh and he pays for all that to be sorted out....i guess in a fair and ideal world thats a pretty good offer...i just need to get my head around seeing it from his point of view....and at the moment the balls in my court.....upset him too much and the court calls the shots...looking at other peoples problems im lucky i dont have
children to worry about...altho they are still upset by his behaviour even tho they are adults...so i should be thankful for that...keep my home and start enjoying life i guess!!

This is the thing here -work out exactly what you 'need' and go for it!!!
The next hurdle is.....will your mortgage company move the mortgage into your sole name?
My mortgage will only lend me 63k, we owe 140k so for me to go sole I need 70-80k!! (which my x can afford in a round about way if he'd stop racking up debt on his new life!!!)

I've followed this and would be really interested in what you decide, would you keep us posted (how nosey of me!)

also, if he's paying for it to be sorted make sure there are no charges or redemption fees for the mort to go sole,

ive already looked into it and they say i can take it over
even got the forms for him to fill out....
as for maintenance .....ive always worked full time....and what with renting a room out...i really dont think i can ask for maintenance....and if i do....its that legal route again isnt it....which costs time and money!!!

I am soon to divorced from a police officer, who is in receipt of his police pension. I am not yet 60 but have an immediate income need.

I appreciate that you say that if a pension is in payment it is discretionary but can you give me any guidance as to where this information is stated i.e any useful pointers to give the police pension trustees. Also, do you have any knowledge as to what discretionary factors might lead to a an immediate pension payment before my age 60?
