What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hello,

I've been reading the site for a while as a guest and found it really helpful and full of useful advice especially for people like me who just cannot afford solicitor fees

I am an applicant in a very messy divorce which has been going on since Feb.

My husband of one year left me for another woman a week after I signed him onto the deeds of my house and we took out a joint mortgage. He went missing and lied to family about his wherabouts so it took 3 months to track him down. He left me a a terrible financial mess which is the reason why I am having to divorce him. A) to get my house back which I have worked very hard for many years to afford, and to ensure that he repays all the money that he ripped me off for.
I am using a solicitor for advice only and self representing due to the enormous costs. As a result of him leaving I am completely broke but because i earn a lot i am not entitled to legal aid.

hence me joining here. I am now getting stuck. I can write statements fine but need to get hold of the right forms.
I have filed form E but he hasn't provided his to me or the court.

1. where do I find a Statement of Issues Form G to download? I've searched HCMS and other sites with no luck. Can anyone tell me where to find one?

2. Is there a standard form for the chronology and if so where do I find that? I have already written a chronology which I submitted with my application.

3. What happens if he doesn't file his form E?

Any help would be gratefully appreciated.

Hi,

Form G, Is actually "Notice of Response To First Appointment" which I believe is a form available from the court.

On the other hand "Summary of Issues" is a document that solicitors just tend to know the format for.

If you need an idea of the lay out of this document then I can email you a copy of mine with personal data obscured if this helps; have done this for a few members on here, along with a copy of the Chronology.

Just send me a private message with your email address.

Regards,

Sarah

Not all court forms are available online so you need to ask your local court about Form G. No forms for Statement of Issues or Chronology - the judge needs brief outlines at a glance. Statement of Issues is a concise summary (bullet points will suffice) of the issues. A chronology for financial proceedings just outlines the brief details in chronological order ;-

date of birth of both parties
date of birth of any children
date of marriage
date of separation
date of the petition
date of the nisi
date of the Forms E
date of the FDA
any other dates relevant, including dates of cohabitation

Forgot no 3. ::S
The chances are he will file Form E, albeit perhaps at the last moment. If not the court will direct him to do so by a given date. If he then doesn't comply you seek further directions (and costs) from the court and ask for him to be given a penal notice should he still not comply.
