What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Ambush! Last minute top representation...

Try and get your head around the fact that it is not an ambush, we all have the right to be represented by a lawyer, your ex does not have to let you know, just court.

Still it was only FDA so little real harm could have resulted, don''t worry about petitions, the who did what and when for the most part is a red herring, tends to just waste time and deviate the mind from the true issues at hand.

Thanks Dukey, I know we both have the right to be represented if we choose, but I think putting a UK ''top 20'' law firm on the record after 5pm Friday for a Monday morning hearing is an ambush by any measure. This was tactical and sorry to say it worked.

Would you consider using a public access barrister for your Final hearing so you don''t feel quite so out-weighed?

Hi Rubytuesday. I''ve tried to economise as much as possible, and can handle myself against barristers, but I need to be prepared. Finances are my least comfortable area so I will definitely get a barrister for final hearing (which it will inevitably go to because of her vexatious approach). In the past I have represented myself when she has had QCs representing her not entirely unsuccessfully. This is a case where, for example, she spent £10k for yesterday''s (non) FA which is more than half her net annual salary, and we have now thus far spent the same amount of money on legal bills (borrowed from family) as we have, in total, in liquid assets. Absolute destructive madness. And to think it could have been sorted out round the mediation table for a few hundred quid...

Unfortunately not having a lawyer can be a false economy because litigants in person do not have training or experience and in family court proceedings it is often necessary to think on your feet. :(

I agree entirely Fiona. The other thing is that you''re emotionally involved which definitely changes your perspective.
