My ex has not answered her questionnaire properly...I wrote to their solicitor I''m November threatening writting to the court if they don''t answer. Obviously they did not answer!
How do a i apply for a penal notice? Which form
Is it? And what do I send with the form?

I think you are getting ahead of yourself a bit here - you need to submit the Schedule of Deficiencies first, and give the other side the opportunity to provide the missing information. My understanding of Penal Notices is that they can only be applied for if a party has refused to follow a Judge''s Directions.

hi

i aleady sent the schedule of deficiencies to the other side in November...they choose to ignore it. the information is quite important so it is needed.
i just dont want another adjourned FDR informing the court before the FDR may help prevent this?

any advice?

No I meant file with the court....I only sent the schedule deficiencies to the other side in November...I did not send anything to the court...

It wasn''t clear at all from your post yesterday that you had only sent a SoD to the the other side and not to the Court. You should have filed a copy with the Court at the same time you sent the SoD to the other side.

I suggest you re-send a Statement of Deficiencies to the other side and file a copy with the Court (see my reply to your post on this for further details).
