What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I have just received by STBX's questionnaire and they are asking for me to provide a completion statement for the sale of my old house from 2012 (which the solicitors that I used is no longer in business) and the second for a house that I currently live in.

What are these completion letters and are they easy to obtain?

The conveyancing solicitor should have the completion statement on file and you should be able to obtain it from them. If they are no longer practising, I believe the SRA (solicitors regulation authority) would require that files are archived. I'm not sure how long they have to store the files for but I would suggest calling the SRA to find out where your conveyancing file is held.

BTW.. The completion statement is a document which shows the net proceeds (showing the deductions for fees/mortgages) from the sale which are payable to the seller upon completion.
