What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

"The Court certifies that the Petitioner proved the contents of the Petition and is entitled to a decree of divorce ..." Date: 12th July 2013. "...the Court has fixed the 15th August 2013 at 10:00am for the pronoucement of a decree...". Will this be the Decree Absolute? On the matter, apart from the fact that the parties are free to re-marry, what does a Decree Absolute actually mean to me, the Respondent? Note that the Children Matters are ongoing (my husband applied for Residence) and the Ancillary Relief process has not started yet, although I have paid my solicitor to apply.Thank you.

This is the date your Decree Nisi will be pronounced; the earliest date from that the Petitioner can apply for the Decree Absolute will be 6 weeks and one day from the 15th August. It is usual to wait and agree upon the finances before applying for the Absolute, and you can request that the Court delay the granting of the Absolute until the finances are resolved, if you wish.

Thank you. The fact that the words "Nisi" or "Absolute" do not appear in the letter leads to confusion. What are my chances of having the Decree Absolute delayed, bearing in mind that the final hearing on Residence of the Children is on 7th October, and that I cannot possibly know until then what my financial situation should be? Can I ask for a delay myself or should my solicitor do it? How much will it cost?
