We have had out timetable set out since February and now my ex is saying he can''t attend the first hearing and will be writing to the court. I would prefer a sooner than later date. Has anyone any experience in stalling tactics like this?

It happens all the time. What your ex probably doesn''t realise is that the court doesn''t just say "oh, you can''t make it - that''s a shame - we''ll list it as a time to suit you. How about 4pm on a Friday? We''ll try to make it quick so you can miss the traffic on the way home"

Your ex will have to make an application to adjourn and relist the hearing and give very good reasons why he cannot attend the hearing.

Thanks Charles. I wonder if they will accept a work training course sufficient enough excuse to adjourn? My thoughts would be if they have known since February then they should state they are unavailable on that date.

More''s to the point, I am sure the work training court would give way to a court appointment rather than the other way around?

The first question a judge is likely to ask is "is the work training course immovable?". If that question is not answered in the letter to the court the judge is likely to deny the request.
