What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

What''s the current (June 2015) waiting time from lodging a Minute for Decree to a Sheriff approval and subsequent Decree of Divorce?

I''ve been advised 4-6 weeks but I''m wondering if anybody has been through this process recently and can validate this?

Tx

4-6 weeks sounds about right; the best person to ask is the court clerk at the particular sheriff court where your divorce is being processed as different courts will vary slightly with the timeframes. Don''t forget that there is a 2 week period between the Sheriff agreeing to grant the divorce, and the actual signing and issuing of the Decree of Divorce.
