What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I''ve ordered a transcript of a hearing where a judge was particularly hostile towards me, and unlike every other request where the court has released the text straight away (same judge), this one has been sat on for about a month and a half now. I asked the transcription firm if they could release the unapproved text to me? No - Ministry of Justice rules, not allowed to do that. I just checked whether I could get a copy of the audio myself to check the text hasn''t been fiddled with. How do you do this? You have to ask the self-same judge for permission! Frightening...

The transcribers have to be approved by the court and they are independent firms who act as independent experts.

A court approved transcription is relied upon by any higher court and must be approved by the court in which it was recorded. Any errors carried forward into a higher court could cause that court to reach an incorrect conclusion based on an incorrect transcription.

If you are alleging a conspiracy of some kind you probably need to step away and take a look at the overall picture. What would a judge have to gain from interfering with a transcription and why would they care whether you agree or disagree with their judgement?

A judge''s role is to hear evidence and make a decision. That decision might be appealed and that appeal might be successful or it might not. The judge will have long since moved onto another case by that stage.

Thanks Charles. Clearly I need to be careful what I say here, but this particular judge is disgraceful, incompetent, and petty - the barristers I have been working with are of the same view. We''re definitely in appeal territory, but it''s a question of timing as it''s no good winning an appeal then simply having the hearing again with the same judge!
