What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hello,
My partner has received a letter from his Solicitor stating the Case number, and stating that Judge Smith approved the Consent Order on November 5th. Not being an expert in these matters, neither of us understand when the actual Divorce will become Absolute and he is no longer married. Can someone please advise whether this was on November 5th, or will something else need implementing/an amount of time needs to pass before this is granted please? Sorry - it''s a very naive question isn''t it.

Thanks,

Hello,

No, not a naive question at all.

Your partner will need to apply for the Decree Absolute using a D36 form - see here - www.wikivorce.com/divorce/Guides-Divorce...Decree-Absolute.html

Only once the Decree Absolute has been granted will he be divorced and no longer married.

Hello rubytuesday,

Many thanks for your quick reply. Is this form D36 what his Solicitor is referring to? **I do not know whether the court have our details for the Decree Absolute. Therefore, if you receive it direct, please let me know as this will bring matters to a conclusion** Thank you,

The Hippy. :)

The D36 is the application form the Decree Absolute - the sols letter is asking that should your parnter have already applied for it himself to let the sols know when he receives the Absolute. He could always instruct them to apply for the Absolute.

Many thanks again rubytuesday, I''ll tell him. He''s convinced every time he phones his Solicitor, it''s costing him money - which he hasn''t got.
