What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

A Decree Nisi was issued to us three years ago. Both of us want to get the Decree Absolute but because it has taken us all these years to come to an agreement about division of finances we have been told that we will have to fill in a form D11. It is important to do this quickly as one of us will be leaving the country at the end of this week. We have made out statements of agreement which we have had witnessed by two friends from either party. This statement explains (to the court) why it has taken us so long to get an agreement. Can I just attach all of this to a form D11 and ask for a quick adjudication ?

It is best not to attach it to a public forum. the court needs to know that nothing has changed which would effect the granting of the decree Absolute. Typically, you would have to confirm that there has been no reconciliation - temporary or otherwise - and no further children have been born.

If you were to telephone a local matrimonial solicitor they might be able to help over the phone or charge a small fee to discuss this discrete matter with you. It depends how valuable this is to you.
