What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

After receiving some advice from a solicitor and Police respectively, I made an Application for Injunction against the estranged wife of my partner of five years.

Yesterday I attended a hearing and an adjournment was requested by the defendant as she informed the court that she had not received my evidence in time to prepare her defence. I had no option but to agree with this adjournment.

During the hearing, The Judge made the defendant take an oath that she would not make any contact with me, directly or indirectly, apart from supplying her defence notes to me. He told her there would be serious consequences if she breached this oath. However, as we left the courtroom, she started staring in my face and goaded me about my appearance. Despite the fact she had just took an oath not to speak to me, she blatantly flouted this.

My father was with me at the time and he witnessed the whole incident and is willing to make a statement. There was also a Court Clerk present. She breached her oath as soon as we walked out of the room and I believe she is now in contempt of court. I am sure there is CCTV footage along the corridors so the courts will be able to view this incident. I tried to leave quietly with my father, it will be apparent to all she was deliberately trying to provoke a reaction, to build up a case against me in time for the next hearing. At the moment she has nothing on me.

Contempt of court is a very serious matter, should I report this and what will happen if I do?

If someone could please get back to me as soon as possible, I would really appreciate it. Thank you!
